The terms for buying a VCHRGD charger, with installation, through our website. How we use your information is in our privacy policy. Questions? Email sales@vchrgd.com.
1. About these Terms
1.1These Terms and Conditions (“Terms”) govern the sale of the electric vehicle charging equipment and associated services (namely delivery and installation) by VCHRGD Technologies Ltd (company number: 13264142 and registered office address: 1a Eghams Court, Boston Drive, Bourne End SL8 5YS) ("we", "our", "us") to consumers purchasing through our website for installation at residential properties within the United Kingdom.
1.2Please read these Terms carefully. By ticking the box to accept these Terms and placing your order, you confirm that you have read and accepted these Terms.
1.3The following definitions carry the following meanings:
- 1.3.1"Additional Works" means any installation works which fall outside the scope of a Standard Installation.
- 1.3.2"Charger" means the electric vehicle charge point, together with any accessories supplied under the Contract.
- 1.3.3"Installation Services" means the installation and commissioning services described in the Contract.
- 1.3.4"Installation Partner" means an independent contractor appointed by us to carry out the Installation Services on our behalf.
- 1.3.5"Property" means the installation address specified in the Order Confirmation.
- 1.3.6"Standard Installation" has the meaning given in Term 3.3.
1.4The following is a summary of the most important Terms, which may have an impact on you:
- 1.4.1If there are issues at your Property which are not apparent from the initial remote survey, additional charges may apply and, if these are not agreed, we may cancel the Contract (Term 3.1.4).
- 1.4.2If you do not complete any pre-installation works required of you within a reasonable period, we may cancel the contract (Term 6.12).
- 1.4.3If you do not provide access to the Property at the appointment time, additional visit charges may apply (Term 6.9).
- 1.4.4Except in the case of personal injury and non-minor damage to property, our liability is limited to the amount paid under the relevant order (Term 15.3).
1.5By ticking the box to accept these Terms and placing your order, you confirm that you have read and accepted these Terms.
2. The Contract
2.1Your order constitutes an offer to purchase the Charger detailed in the Order Confirmation (as defined below).
2.2The contract is formed when we send you an Order Confirmation email (“Order Confirmation”) and no order will be deemed accepted until the Order Confirmation is sent.
2.3These Terms apply together with the details contained in your Order Confirmation (together, these constitute the “Contract”).
2.4By entering this Contract, you confirm that:
- 2.4.1you are over eighteen years old; and
- 2.4.2you are the owner of the Property at which the Charger is to be installed, or have the written authority of the owner for that installation.
3. Ordering Process
3.1The ordering process consists of the following stages:
- 3.1.1You place your order online and pay the purchase price for the Charger (which includes the installation and delivery cost unless we notify you of additional charges due as detailed later in these Terms). If you choose to spread the cost, your finance agreement is with our finance provider and is separate from this Contract.
- 3.1.2You complete our online property survey using our approved survey platform.
- 3.1.3We review the survey to determine whether the installation qualifies as a Standard Installation.
- 3.1.4If Additional Works are required, we will provide a quotation for the additional costs. If you do not wish to pay such additional costs, you may cancel your order for the Charger within five days of receipt of notice of the additional costs. If you do not pay such additional costs and have not cancelled your order within the time period specified above, we may cancel the Contract by written notice.
- 3.1.5Where applicable, any additional costs must be accepted and paid before installation is scheduled.
- 3.1.6Once the survey has been approved and all applicable charges have been paid, we will dispatch the Charger and arrange installation.
3.2We reserve the right to refuse an order where installation is not technically feasible, is commercially impracticable or cannot be safely completed.
3.3A “Standard Installation” includes:
- 3.3.1Provision and installation of the Charger on a brick or rendered wall, or to another suitable permanent structure (i.e. timber).
- 3.3.2Up to 15 metres of EV Ultra cable (or equivalent) run between the electricity supply meter, distribution board and the Charger.
- 3.3.3Routing of the cable through a drilled hole in a wall up to 500mm thick, if this is needed.
- 3.3.4No trenching or groundwork.
- 3.3.5Cable routing, making good and waterproofing relevant drilled holes.
- 3.3.6Up to 6 metres of cable trunking to conceal interior wiring.
- 3.3.7All cabling clipped to the wall to be no greater than 1.8 metres from the finished floor level.
- 3.3.8The fitting and testing of electrical connections and protections required for the Charger.
3.4If we determine from the survey information that your Property is not suitable for the installation of the Charger, we will inform you of this and we may cancel the Contract by written notice to you.
4. Remote Survey
4.1Our installation pricing relies upon the accuracy of the information provided during the online survey.
4.2You agree that:
- 4.2.1all information supplied is complete and accurate;
- 4.2.2photographs accurately represent the installation location; and
- 4.2.3you will notify us if circumstances change before installation.
4.3If the information supplied is inaccurate or incomplete, we may:
- 4.3.1revise the installation price;
- 4.3.2require an additional survey;
- 4.3.3postpone installation; and/or
- 4.3.4cancel the Contract and refund any sums paid less any reasonable costs already incurred where permitted by applicable consumer law.
4.4We will refund you by the method you used for payment. We will not charge a fee for the refund.
5. Standard and Non-Standard Installation
5.1Our advertised installation price applies only to a Standard Installation.
5.2Where the survey identifies Additional Works, including but not limited to longer cable runs, civil works, consumer unit upgrades, earthing works or other site-specific requirements, we will provide a quotation for those Additional Works.
5.3No installation appointment will be booked until any additional charges have been accepted and paid.
6. Installation Services
6.1Installation Services are carried out by approved independent installation partners appointed by us.
6.2We won’t tolerate any physical or verbal abuse. If this occurs, our installation partners have the right to terminate the installation with immediate effect.
6.3All installation work will be carried out in accordance with applicable legislation, industry standards and electrical regulations in force at the time of installation and we remain at all times responsible for the provision of the services under this Contract.
6.4Where required by applicable electrical installation standards or Distribution Network Operator ("DNO") requirements, we will submit the necessary notification or application to the relevant DNO on your behalf as part of the installation process.
6.5You agree to provide any information reasonably required to enable us to make such notification or application.
6.6Where a DNO requires approval before installation can proceed, or imposes conditions, restrictions or requirements affecting the installation, we may delay or reschedule the installation until those requirements have been satisfied. If the DNO requires Additional Works or network upgrades which are outside the scope of the agreed installation, we will notify you of any additional costs or options available before proceeding. Any costs charged directly by the DNO remain your responsibility.
6.7We will not be liable for any delay arising from the requirements, decisions or actions of the relevant DNO or any other utility provider, provided that we keep you reasonably informed of the progress of the notification or approval process. This does not affect your statutory rights.
6.8You agree to provide:
- 6.8.1safe and unobstructed access to the Property;
- 6.8.2access to electricity and internet where required;
- 6.8.3suitable parking for installation personnel; and
- 6.8.4any permissions required from landlords, freeholders or managing agents before installation.
6.9If our installers are unable to complete the installation due to matters outside our control (including where you do not provide access to the Property at the appointment time) or because these obligations have not been met, additional visit charges may apply. These cover the cost of the wasted visit, and we will tell you the amount before the visit is rebooked. We will not charge you for an additional visit that is needed because of a mistake by us or our Installation Partners.
6.10We will not be able to carry out the installation in accordance with the Contract in the following circumstances, where these could not have reasonably been identified through the survey:
- 6.10.1if your electrical installation is not at an acceptable standard, or has insufficient capacity;
- 6.10.2if there is insufficient Wi-Fi/internet connection (or other connectivity as specified by us) at the location of the Charger;
- 6.10.3if any required enabling works of which we have notified you have not been completed by the agreed installation date;
- 6.10.4if the charging cable crosses a public road or public right of way, regardless of whether trip protection is available;
- 6.10.5if there are safety issues at your Property (including the presence of asbestos);
- 6.10.6if your Property is not substantially in accordance with the survey, or has subsequently been altered following the receipt of the survey;
- 6.10.7if the DNO does not issue approval to start the installation; or
- 6.10.8for reasons which we could not reasonably have foreseen.
6.11In this event we will:
- 6.11.1endeavour to agree with you, any additional or varied works we need to carry out and/or any further works that you must carry out;
- 6.11.2endeavour to agree with you any additional charges that may apply in these circumstances (this may include a supplemental call out charge if an additional visit to the Property is required); and
- 6.11.3if we agree the necessary changes, the Contract will be deemed to be varied accordingly and you must pay the additional charges and (where relevant) carry out the further works before the installation can re-commence.
6.12If we are unable to agree to these changes or you fail to carry out the further works within the period specified in our written notice to you (being not less than 14 days), either you or we may cancel the Contract by notice in writing to the other party.
6.13We may have to do work which could cause damage to walls, paint and insulation (for example, we may need to do some wiring inside your Property to install the charge point). We won’t be liable to you for any costs to repair or redecorate your Property, unless we have been negligent with our work. We recommend removing anything fragile or valuable from the area prior to work commencing.
6.14You authorise our installation partners to isolate the electrical supply where reasonably necessary to carry out the installation safely, undertake testing and commission the Charger. We will use reasonable endeavours to minimise any interruption to your electricity supply.
6.15We and our installation partners may take photographs before, during and after installation for the purposes of:
- 6.15.1verifying the installation;
- 6.15.2quality assurance;
- 6.15.3warranty administration;
- 6.15.4demonstrating compliance with applicable regulations and industry standards; and
- 6.15.5maintaining installation records.
6.16These photographs will be processed in accordance with our Privacy Policy and will not be used for marketing purposes without your separate consent.
7. Delivery
7.1The Charger will normally be delivered using our nominated logistics providers on a next working day delivery service once your installation has been approved.
7.2We will use reasonable endeavours to deliver the Charger by any estimated delivery date notified to you. Delivery dates are estimates unless expressly agreed otherwise. If we fail to deliver the Charger within the time required by the Consumer Rights Act 2015, you will have the statutory remedies available under that Act, including the right in certain circumstances to treat the Contract as at an end and receive a refund.
7.3We will use reasonable endeavours to carry out the installation on the agreed installation date or, where no date has been agreed, within a reasonable time. Installation dates are estimates and may need to be rescheduled due to circumstances outside our reasonable control, including adverse weather, availability of parts or installers, safety concerns or the need for Additional Works identified during the installation. If we fail to perform the installation service in accordance with the Consumer Rights Act 2015, you will be entitled to the remedies available under that Act.
7.4Nothing in these Terms excludes or limits your statutory rights.
7.5Risk in the Charger passes to you upon delivery.
7.6Ownership of the Charger remains with us until payment has been received in full.
8. Installation Appointments
8.1Installation appointments will be arranged after:
- 8.1.1the survey has been approved;
- 8.1.2all additional charges have been paid (where applicable); and
- 8.1.3the Charger has been dispatched.
8.2We may rearrange appointments where necessary due to weather, safety concerns, installer availability or circumstances beyond our reasonable control.
9. Cancellation Rights
9.1If you are purchasing as a consumer, you may have the right to cancel the Contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the “Regulations”) from the date of the Order Confirmation until 14 days after the day the Charger is delivered to you. Nothing in these Terms affects your statutory rights. We will only start the Installation Services during the cancellation period if you expressly ask us to, by ticking the box at checkout or by telling us in writing. If you then cancel, you will pay for the services supplied up to the time you tell us you are cancelling, as permitted by the Regulations.
9.2In addition:
- 9.2.1if you cancel after the Charger has been dispatched, your statutory right to cancel is not affected. You will need to return the Charger, or let us collect it, under our returns process, and we may make only the deductions that the Regulations or other consumer protection laws allow;
- 9.2.2where Installation Services have commenced at your express request during any statutory cancellation period, you will pay us a reasonable amount for the Installation Services supplied up to the date of cancellation, calculated in proportion to the total Contract price; and
- 9.2.3where removal of the Charger is required, you will permit us access to recover the Charger and we will not be responsible for any minor damage to your Property caused by such removal. You will remain responsible for any reduction in the value of the Charger resulting from handling or damage beyond that necessary to establish its nature, characteristics and functioning, and for any damage caused to the Charger through misuse or unauthorised removal.
9.3Returned Chargers must be complete and in reasonable condition. We will arrange and pay for the courier collection as long as the Charger is unopened, in good condition and has not been installed. In any other case the cost of returning it is yours.
9.4To cancel, please tell us clearly that you wish to cancel, for example by email to sales@vchrgd.com. You may use the model cancellation form at the end of these Terms, but you do not have to.
9.5Nothing in these Terms limits your statutory rights where goods are faulty, not as described or not of satisfactory quality.
10. Warranty
10.1Our Chargers are supplied with a three-year manufacturer's warranty from the date of installation.
10.2This warranty is additional to your statutory consumer rights.
10.3The installation workmanship is covered by a warranty from the Installation Partner who carries out the work. The length varies by installer and is usually 1 year. We do not give a separate workmanship warranty of our own. This does not affect your statutory rights in relation to the Installation Services.
10.4The manufacturer warranty may not apply where:

- 10.4.2You allow any third party not authorised by us to tamper with the Charger.

10.5Following installation, you must not relocate, modify, disconnect or otherwise alter the Charger or any associated electrical installation except through a suitably qualified electrician and in accordance with the manufacturer's instructions.
10.6We shall not be responsible for any defect, damage or safety issue arising from alterations carried out by anyone other than us or our authorised Installation Partners.
10.7The Charger may interact with electricity suppliers, DNOs, energy management platforms, vehicle manufacturers and other third-party systems. We are not responsible for the availability, accuracy or performance of any third-party services or for any interruption, suspension or withdrawal of such services that affects the operation of the Charger's optional features.

12.2Where reasonably necessary, we may install software or firmware updates remotely or require you to install such updates in accordance with the instructions provided.
12.3You agree not to modify, reverse engineer, interfere with or install unauthorised software on the Charger.
12.4Certain functions of the Charger, including but not limited to smart charging, scheduling, load balancing, remote monitoring, energy reporting and tariff integration, may depend upon internet connectivity, third-party applications or services operated by the manufacturer or other providers.
12.5We do not guarantee the continuing availability of any third-party software, mobile application, cloud service or smart functionality which is outside our reasonable control.
13. Connectivity
13.1Where the Charger requires Wi-Fi, ethernet or mobile network connectivity to provide some or all of its functionality, you are responsible for maintaining a suitable internet connection at the Property unless otherwise agreed.
13.2We shall not be liable for any reduction in functionality resulting from:
- 13.2.1loss of internet connectivity;
- 13.2.2inadequate Wi-Fi signal;
- 13.2.3interruption of third-party communication services;
- 13.2.4changes made by your internet service provider; or

- 14.1.8promptly notifying us of any fault or damage affecting the Charger.
15. Limitation of Liability
15.1Nothing in these Terms excludes or limits liability for:
- 15.1.1death or personal injury caused by negligence;
- 15.1.2fraud or fraudulent misrepresentation;
- 15.1.3breach of your statutory consumer rights; or
- 15.1.4any liability which cannot lawfully be excluded.
15.2Subject to the above, we will not be liable for indirect or consequential loss, loss of profits or loss of business.
15.3Subject to applicable laws and except in the case of non-minor damage to property caused by our negligence (in which case our liability will be limited to the amount actually recovered under our public liability insurance policy), our total liability will not exceed the total amount paid under the relevant order.
16. Data Protection
16.1We process personal information in accordance with our website Privacy Policy which is available at https://www.vchrgd.com/privacy-policy.

17. Intellectual Property Rights
17.1All intellectual property rights in the Charger (other than ownership of the physical Charger itself), including any software, firmware, mobile applications, documentation, trade marks, logos, designs, copyright, databases and other materials supplied by us or the manufacturer, shall remain vested in us, the manufacturer or our respective licensors.

- 17.3.1copy, reproduce, modify or create derivative works from any software or firmware supplied with the Charger;
- 17.3.2reverse engineer, decompile or disassemble the software or firmware;
- 17.3.3remove, alter or obscure any copyright, trade mark or other proprietary notices; or
- 17.3.4use any software or firmware separately from the Charger for which it was supplied.
17.4Nothing in these Terms transfers ownership of any intellectual property rights to you other than ownership of the physical Charger when title passes in accordance with these Terms.
17.5If any software, mobile application or cloud-based service is supplied by a third party, your use of that software or service may also be subject to the licence terms and privacy policies of that third party. Where there is any inconsistency between those licence terms and these Terms in relation to the use of the software or service, the third-party licence terms shall prevail to the extent of that inconsistency.
18. Force Majeure
We will not be liable for delays or failure to perform caused by events outside our reasonable control, including severe weather, shortages of materials, transport disruption, power failures or government action.

In the instance that you do have a complaint or wish to open a dispute, please contact us in the first instance so we can attempt to resolve the issue or dispute informally. To complain, email us at sales@vchrgd.com with your order number and a short description of the problem. We will respond within 5 working days. You are not obliged to accept any method of dispute resolution proposed by us.

21.5These Terms, together with the Order Confirmation and any documents expressly referred to within them, constitute the entire agreement between you and us relating to the sale and installation of the Charger. You acknowledge that you have not relied upon any statement, representation or promise made by or on behalf of us which is not set out in the Contract, except where such reliance cannot lawfully be excluded.
